Toodles Terms of Use

DRAFT - not legal advice - review before publishing

Last updated: 16 October 2026 (DRAFT)

Square brackets mark details still to be confirmed before publication.

1. About these terms

These terms of use (Terms) are a contract between you and ExHale Labs (ABN 84 525 889 101), an Australian business (we, us, our). They cover:

  • the Toodles apps for iPhone and Android, including camera mode;
  • the Toodles website at toodles.dog, including the web quiz, the free Alone-time check, the web camera at toodles.dog/cam and your account area;

together, the Service.

By creating an account, tapping "Get started", using the Service or buying a subscription, you agree to these Terms. If you do not agree, do not use the Service.

These Terms work together with our Privacy Policy and our Subscription Terms. If you buy a subscription, the Subscription Terms apply to that purchase. Any extra terms shown to you when you use a discount code or offer also apply.

2. Who can use Toodles

  • You must be 13 or older to use the Service. When you continue past the first screen, you confirm that you are 13 or older.
  • If you are under 18, you may use Toodles only with a parent or guardian who agrees to these Terms with you.
  • Only adults aged 18 or older may buy a subscription. If you are under 18, ask a parent or guardian to buy it for you [LAWYER: confirm purchase age].
  • If we learn that an account belongs to a child under 13, we will delete it.
  • The Service is for your personal use. Trainers and creators may use discount codes that were issued to them, under the terms that come with each code.

3. What Toodles is

Toodles is a training and wellness tool for owners who are working on their dog's ability to be left alone. It includes:

  • training sessions and graduated absences, planned from your dog's responses;
  • a departure-cue drill, where you practise everyday routines such as picking up your keys;
  • an absence planner, progress history and milestones;
  • camera mode, where a spare phone or a laptop browser watches for movement and sound and can alert you;
  • the web quiz, the free Alone-time check and the web camera.

Toodles is not:

  • veterinary or behavioural treatment, and it does not diagnose or treat any medical or behavioural condition;
  • a replacement for a veterinarian, a certified behaviourist or a qualified trainer;
  • a monitoring service for people, an emergency service or a pet-care service.

4. Your dog's welfare and safety

You remain responsible for your dog at all times.

  • Never leave your dog alone for longer than it can cope with. Our plans aim to stay below your dog's limit, but you know your dog best. Come home sooner if you are worried.
  • Stop the absence and return if your dog shows distress, injury, self-harm, escape attempts through doors or windows, or aggression, or if the app or camera suggests a problem.
  • Talk to a veterinarian first if your dog has a health condition, is on medication, or is older or frail.
  • See a veterinarian or a certified behaviourist if your dog hurts itself, tries to escape and is injured, shows aggression toward people or other animals, or has severe or sudden changes in behaviour. The app shows a "When to see a vet or behaviourist" page with this guidance.
  • In an emergency, contact a veterinarian or an emergency animal hospital straight away. Do not wait for the app.
  • Follow the animal welfare and pet-care laws that apply where you live, including rules about leaving animals alone.
  • Results vary. How your dog responds depends on the dog, your routine and how consistently the training is done. We do not promise any particular result.

5. Alerts and the camera device

  • Camera mode needs a spare phone or a laptop browser that is charged, connected to the internet and placed where it is safe. Keep power cables out of your dog's reach.
  • "Come back now" and other alerts depend on your phone, the camera device, battery, network connection, notification settings and our systems. Alerts can be late or missed. Do not rely on Toodles as the only way to keep your dog safe.
  • The camera analyses sound level and movement on the camera device. These measurements are estimates. They can miss events or flag events that are not a problem.
  • See the Privacy Policy for what the camera does and does not send.

6. Other people in your home

The camera can capture other people and their belongings. You are responsible for:

  • telling household members, visitors and anyone else who may be seen or heard that a camera is in use;
  • following the recording and surveillance laws where you live;
  • not pointing a camera at places where others reasonably expect privacy, such as bathrooms or bedrooms;
  • not sharing the camera feed, snapshots or any images of other people without their permission.

Do not use camera mode to watch, track, harass or frighten any person.

7. Your account

  • When you first open the app, it creates an anonymous ID for you. You can use the Service without giving us an email address.
  • You can add an email address to save your progress, or give us one on the website, so that you can sign in on the web. If you do this, keep your sign-in details secure.
  • You are responsible for activity on your account and on the devices you use to access it. Tell us straight away at help@toodles.dog if you think someone else has access to your account.
  • You must give us accurate information about your dog and your household.

8. Free and paid features

  • The free features include the 3-session baseline check, the departure-cue drill, Monitor mode (sound alerts from a paired camera during real absences) and your dog profile.
  • Premium unlocks the full adaptive plan, the movement and sound early warning, live peek snapshots, the absence planner, the full threshold curve and milestones, the weekly report, and multiple camera devices.
  • We may add, change or remove features. If we remove a paid feature in a way that materially reduces what you have paid for, we will tell you in advance and explain your options, which can include a refund under the Subscription Terms.

9. Subscriptions, trials and refunds

Subscriptions renew automatically unless you cancel. The details are in the Subscription Terms, including:

  • how free trials and introductory offers work;
  • how to cancel, depending on where you bought;
  • refunds. App Store and Google Play refunds are handled by Apple or Google. Website purchases have a 30-day money-back guarantee. EU and UK customers who buy on the website also have a 14-day right to withdraw.

Your rights under Australian Consumer Law are not affected by these refund terms.

10. Your content

  • You own the information you enter, such as your dog's profile, training notes and reflections (your content).
  • You give us a licence to store, process and display your content so that we can provide, support, secure and improve the Service, as described in the Privacy Policy.
  • Do not add content that is unlawful, that infringes someone else's rights, or that includes another person's personal information without their permission.

11. Acceptable use

You must not:

  • use the Service unlawfully, or in a way that harms animals, people or property;
  • copy, resell, reverse engineer or extract the software or content of the Service, except where the law allows it;
  • scrape our systems, overload them, or get around rate limits, access controls or security features;
  • share your sign-in details with others, or give a subscription to someone else;
  • use a discount code or offer that was not meant for you, or create multiple accounts to repeat a free trial or introductory offer;
  • use camera mode to watch or record people.

12. Our intellectual property

The Service, including the apps, website, software, training content, designs, text and branding, belongs to us or our licensors. We give you a personal, non-exclusive, non-transferable and revocable licence to use the Service for your own personal use under these Terms. This licence does not give you any right to use the Toodles name or logos.

13. Stores and third-party services

  • If you downloaded the app from the App Store, Apple's terms also apply. See section 14.
  • If you downloaded the app from Google Play, the Google Play Terms of Service also apply to your use of the app.
  • We use third-party providers to run the Service. The Privacy Policy explains what kinds of providers we use and what they do.
  • The Service may link to other websites. We do not control them and are not responsible for them.

14. Apple terms

If you downloaded Toodles from the App Store:

  1. These Terms are between you and us, not you and Apple. We, not Apple, are responsible for the Service and its content.
  2. Apple's Standard End User Licence Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) also applies to your use of the app.
  3. Apple has no obligation to provide maintenance or support for the app. Send support requests to help@toodles.dog.
  4. If the app does not meet any applicable warranty, you may tell Apple, and Apple may refund the purchase price (if any). To the maximum extent the law allows, Apple has no other warranty obligation for the app. Any other warranty is ours under these Terms.
  5. We, not Apple, are responsible for dealing with any claim relating to the app, including product liability claims, claims that the app does not meet legal or regulatory requirements, and claims under consumer protection law.
  6. We, not Apple, are responsible for investigating and handling any claim that the app or your use of it infringes a third party's intellectual property rights.
  7. You must comply with any third-party terms that apply when you use the app.
  8. Apple and its subsidiaries are third-party beneficiaries of these Terms. When you accept these Terms, Apple has the right to enforce them against you.
  9. You confirm that you are not located in a country that is subject to a United States government embargo, and that you are not on any United States government list of prohibited or restricted parties.

15. Disclaimers

  • To the extent the law allows, the Service is provided as described in these Terms, and we do not promise that it will always be uninterrupted or error free.
  • We do not promise any particular result for your dog, your household or your goals.
  • Nothing in these Terms excludes, restricts or changes any right or guarantee you have under the Australian Consumer Law or any other law that cannot be excluded. Under the Australian Consumer Law, our services come with guarantees that they will be provided with due care and skill, and that they will be reasonably fit for the purpose you made known to us.

16. Limits on our liability

  • Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by our negligence, or for fraud.
  • Where the Australian Consumer Law applies and we are permitted to limit liability for a failure of a consumer service, our liability is limited to supplying the service again or paying the cost of having it supplied again.
  • To the extent the law allows, our total liability to you for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim.
  • We are not responsible for decisions you make about your dog, including how long you leave your dog alone, or for the actions of other people in your home.

17. Ending your account

  • You can delete your account at any time. See the Privacy Policy, section 10.
  • Deleting your account does not cancel a subscription bought through the App Store or Google Play. Cancel it in your store account first, or it will keep renewing.
  • For a web subscription, cancel it in your account area at toodles.dog/account before you delete your account.
  • We may suspend or end your access if you seriously or repeatedly break these Terms, such as through fraud, abuse or unlawful use. Where we can, we will tell you first. If we end your access for a reason other than your breach, we will refund any prepaid, unused part of your subscription, as the Subscription Terms explain.

18. Changes to these Terms

We may update these Terms. For material changes, we will tell you in the app or by email at least [30] days before the changes take effect, unless a change is needed sooner to meet the law or to fix a security problem. If you do not agree to a change, you can delete your account and cancel any subscription. Continuing to use the Service after a change takes effect means you accept it.

19. Governing law and disputes

  • These Terms are governed by the laws of [State or Territory], Australia.
  • Please contact us first at help@toodles.dog so that we can try to resolve your complaint. We aim to respond within [30] days.
  • Courts in [State or Territory], Australia have jurisdiction over disputes, but you keep any rights you have under the law of the country where you live, including consumer protection rights.
  • You can make a privacy complaint to the Office of the Australian Information Commissioner (oaic.gov.au), and you can contact your state or territory consumer protection agency.
